How To Change Your Gender Marker on a NJ Birth Certificate and Driver’s License

 

In New Jersey, you can change the gender marker on your birth certificate and driver’s license without requiring proof that you had “gender reassignment surgery.”

Changing Your Birth Certificate

To change the gender identity on your birth certificate, you need to file an application with the New Jersey Department of Health. You may change the gender identity listed on your birth certificate to M, F, or “Undesignated/Non-binary.” The “undesignated/non-binary” category covers “all gender identities that are not exclusively male or female.”

You will need to formally state that “my request for a change in gender to ◼ Female ◼ Male ◼ Undesignated/Non-binary is to conform my legal gender to my gender identity and is not for any fraudulent purpose.”

The Request Form and Attestation (REG-L2) to Amend Sex Designation to Reflect Gender Identity on a Birth Certificate - Adult application and the Parent/ Guardian Request Form and Attestation (REG-L3) to Amend Sex Designation to Reflect Gender Identity on a Birth Certificate – Minor are available online, and can be printed and mailed to Office of Vital Statistics and Registry, Records Modification Unit, New Jersey Department of Health, P.O. Box 370 Trenton, NJ 08625-0370. You may also complete the application online at the Office of Vital Statistics and Registry's Request Form and Attestation to Amend Sex Designation to Reflect Gender Identity on a Birth Certificate page. There is no fee for filing an application. A certified copy of the new birth certificate is $6.

Changing Your Driver’s License

To change the gender marker on your New Jersey license or non-driver identification card, you need to file an application with the New Jersey Motor Vehicle Commission. You may change your gender identity to X, indicating that the gender identity is “unspecified.” You will need to formally state that “the request for change in gender is to conform my legal gender to my gender identity and is not for any fraudulent purpose.”

The Declaration of Gender Designation Change for New Jersey Motor Vehicle Commission Driver License or Non-Driver Identification Card application is available online, but you must go to a New Jersey DMV office to make the change. You will also need to turn in your current New Jersey driver’s license and pay a fee of $11 to receive a new driver’s license. ​​
